The Family Code Sections address the rights and responsibilities of a minor who has been declared emancipated by the court or who has become emancipated under present decisional case law.

A person under the age of 18 years is an emancipated minor if any of the following conditions are satisfied:

  1. The person has entered into a valid marriage, whether or not the marriage has been dissolved
  2. The person is on active duty with the armed forces of the United States
  3. The person has received a declaration of emancipation pursuant to Section 7122

As an emancipated minor, the individual is subject to all responsibilities, contracts or wills signed; he or she may buy, sell, or lease real property, etc., and is free to pursue work or personal interests of choice.
