In arbitration, each side in a dispute presents its case, including evidence to a neutral third party called an "arbitrator" rather than to a judge. The arbitrator issues an award based on the evidence, just as a judge would in a court. Although evidence is presented, arbitration is a less formal process than a court litigation.

Arbitration may be "binding" or "nonbinding" depending on what the parties agree to before beginning the process. "Nonbinding arbitration" means that the disputants in the case are not required to accept the arbitrator's award; they may request a new hearing in court. In binding arbitration, the disputants agree that the arbitrator's decision is final.

The American Arbitration Association (AAA) is a public service, nonprofit organization offering a broad range of dispute resolution services to business executives, attorneys, individual employees, trade associations, unions, management, consumers, families, communities, and all levels of government. These services include administration of such dispute resolution methods as arbitration, mediation, mini-trial, impartial elections, and other voluntary settlement procedures.
