Business and Professions Code Chapter 10, Sections 21700 -21712 establishes procedures for the owner of a self-service storage facility to give preliminary notice of lien placement, giving public notice of lien sale, the hearing on the "Declaration in Opposition to Lien Sale," and other procedures which must be followed for legal dispensation of stored goods.
If the owner of a self-service storage facility violates any of the procedures stated in the Business and Professions Code, the consumer may resort to civil procedures, such as small claims court. The consumer should report the violation to the District Attorney; If the same owner of this storage facility violates this procedure in subsequent lien placements, the action would constitute fraud and involve the District Attorney's office.
