The California Department of Real Estate enforces real estate laws to protect consumers in the sale or lease of real property. The Department qualifies applicants for real estate licenses, promotes professional and ethical standards in real estate brokerage, and regulates the sale or lease of subdivided property and property securities, investigates complaints involving unlicensed activities or unlawful activities of real estate licensees and land subdividers.

Complaint jurisdiction:
Unfair, misleading, or fraudulent treatment by a licensee in any real estate or business transaction.

Complaints outside jurisdiction:

Disputes involving commissions; return of deposits; restitution demands; complaints against entities or individuals exempt from real estate license requirements (for example: resident managers of apartment buildings or their employees, employees of lending institutions, federally regulated lenders, licensed personal property brokers, and cemetery authorities).

Escrow companies are not under the department's jurisdiction.

See Homeowner's Associations for explanation of California Department of Real Estate's involvement in homeowners' associations.

Mortgage companies are regulated by the California Department of Real Estate only when loans are being brokered (negotiated between the borrower and lender).

Pre-paid rental listing services are required to be licensed by the California Department of Real Estate.
