Under Title 2 of the Americans With Disabilities Act, the United States Department of Transportation prohibits discrimination on the basis of disability to all programs, activities, and services provided or made available by state and local governments or agencies, regardless of whether or not these entities receive federal financial assistance. It also extends coverage to all public entities that provide public transportation, whether or not they receive federal aid.
Title 3 extends the prohibition against disability discrimination to privately operated public accommodations and prohibits discrimination in public transportation services provided by private entities.
