The California Family Code 7002, 7050-7052 address the rights and responsibilities of an emancipated minor who has been declared emancipated by the court or who has become emancipated under present decisional case law.
Any person under the age of 18 years who comes within the following description is an emancipated minor:
- Who has entered into a valid marriage, whether or not such marriage was terminated by dissolution; or
- Who is on active duty with any of the armed forces of the United States of America; or
- Who has received a declaration of emancipation pursuant to Section 7122.
As an emancipated minor, the individual is subject to all responsibilities, contracts or wills signed; he or she may buy, sell, or lease real property, etc., and is free to pursue work or personal interests of choice.
